In a deeply contentious ruling, the US Supreme Court, with a 5-4 majority, upheld a lower court decision that significantly expands presidential power. The case, *Trump v. United States*, centered on a legal challenge to Executive Order 77, enacted by then-President Trump, which authorized the president to deploy the military to suppress domestic unrest, detain individuals deemed national security threats indefinitely without judicial review, and seize private property in the name of national security. Opponents argued the order violated fundamental constitutional rights, including due process, freedom of assembly, and protection against unlawful search and seizure. However, the Supreme Court's majority opinion, penned by Justice Kavanaugh, asserted the order was a valid exercise of presidential authority under Article II of the Constitution, particularly during times of national emergency. The ruling effectively allows the president to bypass Congress and the judiciary in matters of national security, raising concerns about the potential for abuse of power and the erosion of democratic checks and balances. Dissenting justices warned the decision sets a dangerous precedent, paving the way for a presidential dictatorship and undermining the foundations of American constitutionalism. The decision has sparked widespread protests and intensified political polarization, with civil liberties groups vowing to continue the fight against what they see as an authoritarian power grab. find the original article here: https://www.wsws.org/en/articles/2025/04/09/jzif-a09.html
